Professional codes and bodies
Many experts also work under the code of conduct of a professional body or expert association. These sit on top of Part 35 — they do not replace the duty to the court. We link to them rather than reproducing them, as they are the bodies' own copyright material.
Key points
- The Academy of Experts and the Expert Witness Institute (EWI) each publish a code of practice / conduct for members.
- Regulated professionals carry their regulator's duties too — e.g. doctors acting as experts must follow GMC guidance on acting as a witness.
- Where a code is stricter than Part 35, follow the stricter standard; where they conflict, the duty to the court prevails.
